Terms of Service

By accessing our website, submitting a contact or project request, or engaging our services in any capacity, you confirm your agreement to these Terms of Service. These terms constitute a legally binding agreement between you and us. We reserve the right to update these terms at any time, and continued use of our services following any update constitutes acceptance of those changes.

We provide custom digital services including but not limited to: website design and development, mobile application development, ecommerce development, API and third-party system integrations, AI chatbot configuration, SEO and digital marketing strategy, and ongoing maintenance.

All project scope, deliverables, timelines, and pricing are agreed upon in a written proposal or project brief before work commences. Any changes to agreed scope must be documented and may affect pricing and delivery timeline.

Projects require a deposit before work begins, typically 50% of the agreed total. The remaining balance is due upon project completion and before final delivery or deployment. Payment schedules for larger projects may be structured in milestones as agreed in writing.

Invoices are payable within 30 days of issue unless otherwise agreed. Late payments may incur interest and may result in suspension of services or delay in delivery.

Refund eligibility is assessed on a case-by-case basis depending on project stage and circumstances. Deposits are generally non-refundable once work has commenced unless we are unable to fulfil the agreed scope. All refund decisions are made in writing.

Upon receipt of full and final payment, you receive full ownership of all custom work created specifically for your project, including source code, design assets, and written content produced by us for your engagement.

We retain the right to display your completed project in our portfolio, case studies, and promotional materials unless you request in writing that we refrain from doing so. We respect confidentiality requests and will honour non-disclosure agreements where applicable.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services, including but not limited to loss of business, revenue, data, or profits. Our total liability for any claim arising from our services shall not exceed the total fees paid by you in the 12 months preceding the claim.

Both parties agree to treat all project-related information as confidential. We will not disclose your business plans, proprietary information, or technical specifications to third parties without your written consent. This obligation survives termination of the service engagement.

Either party may terminate the engagement with reasonable written notice if the other party materially breaches these terms and fails to remedy the breach within a reasonable period. Upon termination, all outstanding payments for work completed become immediately due.
